Terms and Conditions
THE SOCIAL BOSS BUSINESS POLICIES AS OF 1 AUGUST 2019.
1. BACKGROUND
The Social Boss aims to achieve the highest level of client satisfaction as well as for our clients to have absolute faith in the standard of work and the professional manner in which we conduct our business.
2. TERMS OF SERVICES TO BE PROVIDED
Working Hours
Working hours are stipulated as 08:00 AM – 16:00 PM Monday to Friday. Weekends and Public Holidays are not part of our working hours.
The Social Boss maintains the right to; (i) respond to any form of communication made by the client during the stipulated working hours only; (ii) in the event that the client communicates with The Social Boss during non-working hours, such communications will only be answered once working hours commence; (iii) no telephonic phone calls will be answered during non-working hours.
In the event that the client requires content to be posted during the non-working hours please ensure that; (i) The client communicates such need for content to be designed and posted on such day (stipulated); (ii) such content is made available timeously to ensure that the content can be designed and approved before the agreed upon day.
The Design Process
The Social Boss will be in contact with the client on a Monday in order to obtain the following; (i) any content that the client requires for the week ahead; (ii) such content will be required from the client in order for it to be designed in a timeous manner; (this is dependent on the amount of posts per week that is agreed to in your contract); (iii) For creative content to be designed, please ensure that you send your content on or before Monday at 14:00pm, this gives us enough time to create, send proof and change any issues you may have and be able to post all post during the week as stipulated in your contract. (iv) the designing of content will only take place during working hours. in the event that no content is received, the Social Boss will continue to post content that is effective for your business.
The Social Boss will be in contact with the client during working hours to discuss the content that needs to be designed and posted for the week. It is imperative to understand that creative content needs to be well designed and thought-out, as such it is a timeous process.
Once the content has been created you will be sent proof of the content that is to be posted; Once proof has been sent to the client, the client has the option to go ahead with the design that has been presented, or alternatively the client may request certain changes to be made to the design, please take note of the following; (i) The client has the option to change aspects of the design if they feel the need to, (ii) Such changes will be made and further proof will be sent for approval; (iii) The Client has the option to change as many aspects of the proof as they wish, however please ensure that all changes are stipulated at the outset of the first proof sent, (iv) The Client is entitled to one re-design of the second proof, as such please ensure that you state all the changes you want made at the outset. (vi) No more than 2 proofs will be sent for approval, as this takes time away from creating content for our other clients.
Once the content has been posted with your consent, please note (i) such content will not be taken down and re-done or altered in any way. (ii) the client will have consented to the proof provided and as such agrees with the content being posted. (iii) it is for this reason that we have the following procedure set above with regard to proofs being sent.
Content to be posted
The client is entitled to all posts that have been agreed to in their respective contract. as such (i) If the client requires an extra post to be made, for example specials and such post is not part of the agreed to posts per week, (ii) the Social Boss reserves the right to charge R150.00 per extra post made, which is not stipulated in the contract, (iii) such extra cost will be added to the bill of the client at the end of the month.
3. NOTICES
As the Social Boss is a Sole Proprietor, in the event that an emergency presents itself; (i) Clients shall be notified of such emergency or illness in a timeous manner, as permitted in the situation.
As per the confidentiality clause. The Social boss will not entertain any queries with regards to the business’s we are contracted to. Further, we will conduct our business in a professional manner, in such each client will be treated the same, in a fair manner and the respective attention will be applied to each client.
The Social Boss, will under no circumstances entertain any third-party interference. Please take note of the following; (i) The Social Boss will only correspond with the client that is contracted to us, (ii) We will not reply or entertain queries from a third party on behalf of the client, (iii) once we have consent to post content from our client, a third party cannot request to change or take down the post. (iv) unless you are a client of The Social Boss, we will not take orders from a third party, (vi) further, as a third-party that is not contracted to us, we cannot create content for you through one of our clients, this is against our policies and is a blatant abuse of our services.
4. PAYMENT TERMS
The Social Boss maintains the right to elect the date for payment of the services rendered. As such payment shall be made on the 1st of every month.
5. CONFIDENTIALITY
The Social Boss shall maintain absolute confidentiality with respect to any confidential information received from the client, and shall not disclose any such information without obtaining clients specific prior consent. (i) the specific terms of the agreement; and (ii) information that is proprietary or confidential to each business.
In the event that The Social Boss is contracted to more than one business in the same field, please take note; (i) No information will be shared with regards to any business practices, products or future dealings. (ii) each business will be treated fairly and equally.
6. TERMINATION
Either party to the contract may terminate the agreement by giving 1 month/ 30-day written notice to the other, without assigning any reason whatsoever. The obligations of the parties shall continue during the notice period. (payment is implied for the notice period).
Take further notice that no pro-rata payments will be permitted. termination shall be effective after the 30-day notice.
